Single End-User License Agreement for the
3D Apex Predictive Failure Technology® and Trading Methodology

THIS IS YOUR LEGAL RESPONSIBILITY - READ THIS COMPLETELY

It Is Unfortunate, But The Following Agreement Is Necessary In Order To Properly Serve You:

This Single End-User License Agreement (EULA) is a legal agreement between you (either an individual or a single entity) and the creator, author, owner and developer "Roger Khoury" for conditional access to his proprietary 3D Apex Predictive Failure Technology® and all related derivatives for the trading analysis, forecasting and timing of the world’s financial markets, which includes any and all related information, indicators and settings, concepts, intellectual property, developed methods as well as strategies which also includes any and all associated media (audio and video), printed materials, and “online” or electronic documentation and/or training sessions of any kind and in any form, as well as any proprietary software, all of which may be already developed or will be developed in the future herein referred to as "THE PRODUCT".

Regardless of when you have been provided access to the proprietary information whether for consideration or gratis whether before or after the signing of this document, you understand and agree that this information is Copyrighted by Roger Khoury and is considered to be his trade secret and is highly proprietary in nature, and by accessing any and all related information including, but not limited to client member areas, accepting any files tangibly or electronically delivered, shared or posted, or otherwise accessing and using THE PRODUCT in any way, you agree to be bounded by the terms of this EULA. If you do not agree to the terms of this EULA, Do Not Use THE PRODUCT and Immediately Delete and Destroy All Instances of the THE PRODUCT where no part of it can be accessed, viewed, consumed, and/or used in any manner.

INDIVIDUAL PRODUCT LICENSE

3D Apex Predictive Failure Technology® and Trading Methodology along with any of its derivatives, whether directly or indirectly related, known as THE PRODUCT, is being distributed for personal, NON-commercial/NON-business use, and for your personal educational purpose ONLY. You are NOT allowed to share or distribute THE PRODUCT or its contents to anyone, at any time, in any way or form (whether for profit or not) or take any compensation or provide service utilizing THE PRODUCT and any of its contents to any third party. Any access to THE PRODUCT is granted ONLY to individuals and/or parties that have at least a mutually signed NDA/NCA/NSA (Non-Disclosure/Non-Compete/Non-Solicitation Agreement) and EULA (End User License Agreement) with Roger Khoury and RBJ Financial Group.

Your access and single personal end user license for use of THE PRODUCT is NOT TRANSFERABLE. Working for or soliciting to start or grow a fund or advisory firm/service/product, whether new or currently existing, as well as utilizing any aspect of THE PRODUCT in any business or commercial capacity, including but not limited to executing investment/trading positions, providing analysis, research and or advice of any type to anyone in any capacity is STRICTLY PROHIBITED. Any and all interactions intended outside of your own personal and private NON-commercial/NON-business use, whether for profit/compensation of any kind or not, MUST BE AUTHORIZED IN WRITING by Roger Khoury prior to any implementation or execution of any such activity. Not doing so will be regarded as a breach in confidentiality, of this agreement and a dishonorable form of competition and is therefore strictly PROHIBITED.

YOUR SPOUSE, if married, is required to have a copy of THIS EULA (End User License Agreement) SIGNED as well as a copy of the NDA/NCA/NSA (Non-Disclosure/Non-Compete/Non-Solicitation Agreement) SIGNED. Not doing so will be considered a breach of this agreement.

You are accessing highly privileged and proprietary information. The information you have or will gain access to related to 3D Apex Predictive Failure Technology®, 3D Apex Trading Methodology™, The 3D Apex Power Indicator™, 3D Apex P.A.L.™ (3D Apex Probability Analysis Layer™), The Market Doctor's™ Rules of Engagement, 3D Apex Rules of Engagement™, RBJ Pilot Fish Methodology™, RBJ A.R.C.™ (RBJ Accelerated Retirement Community™), 3D Apex Market Maps™ and all forms of related information are being tracked.

This privileged and confidential information is considered a Trade Secret. It is highly proprietary and is copyrighted by Roger Khoury (The owner, creator, author and developer of THE PRODUCT and any of the above mentioned derivatives of THE PRODUCT) and is provided strictly for authorized individuals only and is provided to you strictly for your own personal and private NON-commercial/NON-business consumption and use. You do not have permission to share this information with anyone, for any reason, in any way, at any time and NO PART of this proprietary information can be used in or for any commercial or business interest.

To be extra clear: We do not know or have any agreement in place with anyone but the authorized individual with signed agreements in place who will be accessing THE PRODUCT and or any related information/product/service. Therefore, you may not share this with your best friend, your significant other, your family member, your business partner, your employee/assistant or ANY person not already authorized in writing with the proper agreements signed and accepted by Roger Khoury. As per the signed agreements, COMPLIANCE IS YOUR LEGAL RESPONSIBILITY. Please take this as seriously as we do.

If you have any questions or concerns about any of this, please do not hesitate in contacting us through the various forms of contact links provided through any of our websites, information portals, forms, etc. This information may be updated without notice and it is your responsibility to stay up to date with the terms and conditions of use which will be posted to our notices and or terms of use located through our website or any of our information portals.

GRANT OF LICENSE
This EULA grants you the following rights: Download, Installation and Personal Use. You may download, install and use any files or proprietary settings within the client member area or files received from the author or any of his associates, clients or companies, as well as any files generated during a recorded or publicly broadcasted session for PERSONAL, NON-COMMERCIAL/NON-BUSINESS USE ONLY.

REPRODUCTION AND DISTRIBUTION
You are specifically and explicitly prohibited from reproducing, sharing, and/or distributing any aspect of THE PRODUCT to any other individuals or entities. You may reproduce content obtained from THE PRODUCT, the author, or his associates or companies for PERSONAL, NON-COMMERCIAL/NON-BUSINESS USE ONLY and you further agree that you will protect this information as agreed upon in the signed NDA/NCA/NSA (Non-Disclosure/Non-Compete/Non-Solicitation Agreement).

DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS
Limitations on Reverse Engineering, Disassembly, Recompilation and change (i.e. adding, deleting or modifying): YOU MAY NOT reverse engineer, disassemble, recompile, or modify/change THE PRODUCT or any related aspects and or derivatives of THE PRODUCT.

TERMINATION
Without prejudice to any other rights, the Author of THE PRODUCT may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must immediately stop using THE PRODUCT and immediately delete/destroy all copies of THE PRODUCT’s login information and any/all of its component parts you may have downloaded, printed, saved or installed on your personal computers or any devices.

COPYRIGHT
All title and copyrights in and to THE PRODUCT (including but not limited to any images, photographs, clipart, libraries, settings, templates, indicators, and examples incorporated into THE PRODUCT), the accompanying printed materials, and any copies of THE PRODUCT are owned by the Author of THE PRODUCT. THE PRODUCT is protected by copyright laws and international treaty provisions. Therefore, you must treat THE PRODUCT like any other copyrighted material.

LIMITED WARRANTY
NO WARRANTIES.
The Author of THE PRODUCT expressly disclaims any warranty for THE PRODUCT. THE PRODUCT and any related documentation is provided “as is” without warranty of any kind, either express or implied, including, without limitation, the implied warranties or merchantability, fitness for a particular purpose, or non-infringement. The entire risk arising out of use or performance of THE PRODUCT remains with you.

NO LIABILITY FOR DAMAGES
In no event shall the author of THE PRODUCT be liable for any special, consequential, incidental or indirect damages whatsoever (including, without limitation, damages for loss of personal/business profits, personal/business interruption, loss of personal/business information, or any other pecuniary loss) arising out of the use of or inability to use this product, even if the Author of THE PRODUCT is aware of the possibility of such damages and known defects.

GENERAL PROVISIONS
This Agreement shall be construed under the laws of the state of Delaware. This Agreement shall not be assignable by either party. Neither party may delegate its duties under this Agreement without the prior written consent of the other party.

If any provision of this Agreement is held to be invalid, illegal or unenforceable, the remaining portions of this Agreement shall remain in full force and effect and construed so as to best effectuate the original intent and purpose of this Agreement.
